Guana is a peer-to-peer ridesharing platform that facilitates cost-sharing between drivers and passengers traveling between destinations in Costa Rica. Guana acts as a technology intermediary and is not a transportation company, carrier, or provider of transport services.
Guana does not employ drivers, set fares, determine routes, or control the conduct of its users. All trips arranged through the Platform are agreements between individual users.
All content on the Guana platform — including but not limited to the name "Guana," the Guana logo, app design, user interface, graphics, text, software code, and documentation — is the intellectual property of Guana or its licensors and is protected by applicable intellectual property laws.
No part of the Platform may be reproduced, distributed, modified, publicly displayed, or used for commercial purposes without prior written authorization from Guana.
Third-party trademarks, service marks, and logos appearing on the Platform are the property of their respective owners.
The information and content provided on the Platform is for general informational purposes. While we strive to keep information accurate and up to date, Guana makes no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, or availability of the Platform or the information contained therein.
Guana does not guarantee that the Platform will be available at all times, uninterrupted, or error-free. We reserve the right to modify, suspend, or discontinue any part of the Platform at any time without prior notice.
User-generated content, including trip listings, profiles, ratings, and reviews, represents the views and experiences of individual users and does not reflect the opinions or endorsement of Guana.
To the maximum extent permitted by applicable law, Guana and its developer shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from: (a) your use of or inability to use the Platform; (b) any trip arranged through the Platform; (c) any conduct or content of any user; (d) unauthorized access to or alteration of your data; or (e) any other matter relating to the Platform.
This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other legal theory, even if Guana has been advised of the possibility of such damages.
The Platform may contain links to or integrations with third-party services, websites, or applications. These include authentication providers (Google Sign-In, Apple Sign-In), identity verification (Didit), and infrastructure services (Supabase).
Guana has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party services. Your use of third-party services is governed by their respective terms and policies.
This Legal Notice and any disputes arising from or relating to the Platform shall be governed by and construed in accordance with the laws of the Republic of Costa Rica.
For any legal proceedings, the competent courts of Costa Rica shall have exclusive jurisdiction.
